By accessing or using any of the Ohio Dermatological Association’s (ODA) website, you agree to comply with and be bound by these Terms and Conditions of Use (Terms of Use). Please read these Terms of Use carefully as well as the ODA’s Privacy Policy, which is incorporated herein by reference. If you do not agree with these Terms of Use, you must immediately terminate use of the ODA website. These Terms of Use will take effect at the time you begin using the ODA website. The ODA reserves the right, with or without notice, at any time and for any reason to deny you access to the ODA website or any portion thereof, and to terminate these Terms of Use. If you violate any of these Terms of Use, your permission to use the website automatically terminates.

All ODA content including the name and logo and all related product and service names (“ODA Content”) on this site is owned by the ODA, its licensors, sponsors, partners, content providers, or other third parties and is protected by law including, but not limited to, United States copyright, trade secret, patent, and trademark law. Reproduction, retransmission, distribution, sale, publication, broadcast, circulation, reprinting, or dissemination of any ODA Content is prohibited without prior written permission from the ODA or the other copyright owner if the ODA is not the owner. You may not alter, delete, obscure, or conceal any copyright or other notices appearing on the ODA Content, including any such notices appearing on any ODA Content you are permitted to download, transmit, display, print, or reproduce from ODA websites. Use of content

The ODA authorizes you to view or download a single copy of the material on the website solely for your personal, noncommercial use. 

All other reproduction, retransmission, or reprinting of all or part of any ODA Content found on this site is expressly prohibited, unless the ODA has expressly granted its prior consent to so reproduce, retransmit, or reprint the material. All other rights are reserved.

The ODA is providing information and services on this website as a benefit and service in furtherance of the ODA’s nonprofit and tax-exempt status. Please consult an appropriate health care provider with any medical issues you may have. The ODA does not answer specific medical questions or refer people to a particular dermatology professional. Reference to any product, service, hypertext link to a third party or other information by trade name, trademark, supplier or otherwise does not necessarily constitute or imply its endorsement, sponsorship or recommendation by the ODA. The ODA shall not be responsible for any loss or damage of any kind incurred as a result of the presence of such third party content. Online conduct

You warrant that you will abide by all applicable local, state, national and international laws and regulations with respect to your use of the ODA website and not interfere with the use and enjoyment of the ODA website by other users or with the ODA’s operation and management of the website. You agree to use the website only for lawful purposes and are prohibited from posting on the website any unlawful, harmful, threatening, abusive, harassing, defamatory, obscene or otherwise objectionable material of any kind, including, but not limited to, any material which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national or international law.

You agree to only post or upload media (like photos, videos or audio) that you have taken yourself or that you have all rights to transmit and license and that do not violate trademark, copyright, privacy or any other rights of any other person. Photos or videos of celebrities and cartoon or comic images are usually copyrighted by the owner.

To protect your privacy and/or the privacy of others, you agree that you will not submit any media that contains personally identifiable information, including protected health information as defined by the regulations issued under the Health Insurance Portability and Accountability Act of 1996 (including but not limited name, phone number, address, email address or web site URL.) of you or of anyone else. Uploading media like images or video of other people without their permission is strictly prohibited.

The ODA is a distributor of the content supplied by third parties. Any opinions, advice, statements, services, offers or other information or content made available by third parties are those of the respective author(s), and the ODA is not responsible for any material posted by third parties. The ODA cannot and does not endorse in any way, nor does it vouch for, the accuracy or usefulness of such material. Furthermore, the ODA expressly disclaims any liability associated with material posted by third parties.


You agree to defend, indemnify, and hold the ODA, its officers, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms of Use.

Governing law/forum

You expressly agree that exclusive jurisdiction for any dispute with the ODA, or in any way relating to your use of the website, resides in the courts of the State of Ohio and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the State of Ohio in connection with any such dispute including any claim involving the website or the ODA or its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers, and content providers.

These Terms of Use are governed by the internal substantive laws of the State of Ohio, without respect to its conflict of laws principles.


If any provision of these Terms of Use is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Use, which shall remain in full force and effect. No waiver of any of these Terms of Use shall be deemed a further or continuing waiver of such term or condition or any other term or condition.

Except as expressly provided in a particular "legal notice" on the website, these Terms of Use and the ODA Privacy Policy constitute the entire agreement between you and the ODA with respect to the use of the website and ODA content.


Special proprietary notice and disclaimer

The "Find a Dermatologist" is produced by the ODA as a reference of professional information on individual dermatologists. It is intended to provide the public with quick access to information on dermatologists who are members of the ODA. Neither database, nor any of their data, listings, or other constituent elements may be downloaded, republished, or duplicated, in whole or in part, for commercial purposes, for purposes of compiling mailing lists or any other lists of dermatologists, or for any other purposes without the prior express written permission of the ODA.  

Although the ODA warrants that it undertakes reasonable efforts to keep the information contained in its "Find a Dermatologist" database accurate, the ODA does not warrant the accuracy, completeness, timeliness, or fitness for a particular purpose of the information contained in those databases, or in any way endorse the individuals described therein. The above warranty is the only warranty of any kind, either express or implied, including warranties of merchantability or fitness for any particular purpose, made by the ODA with respect to the "Find a Dermatologist" database. In no event shall the ODA be liable for any decision made or action taken in reliance on the information contained therein.

Privacy policy

The ODA is committed to maintaining the privacy of the personal information of visitors to its sites. Our policies are designed to disclose the information collected and how it will be used. This policy applies solely to the information provided while visiting this website. The terms of the privacy policy do not govern personal information furnished through any means other than this website (such as by telephone or mail).

Email addresses and other personal information

Personal information such as postal and email address may be used internally for maintaining member records, marketing purposes, and alerting customers or members of additional services available. Phone numbers may also be used by the ODA when questions about products or services ordered arise. The ODA will not reveal any information about an individual user to third parties except to comply with applicable laws or valid legal processes.

This website is not designed or intended to attract children under the age of 13, except for the materials expressly designed for educational purposes for children.

The ODA implements security measures to protect against unauthorized access to or unauthorized alteration, disclosure, or destruction of information. We restrict access to personal information to the ODA’s business partners who may need to know that information in order to operate, develop, or improve our services. These individuals are bound by confidentiality obligations and may be subject to discipline if they fail to meet these obligations.

Unfortunately, no information transmission over the Internet can be guaranteed to be completely secure. Accordingly, despite our efforts, the ODA cannot guarantee or warrant the security of any information you transmit to us.
